RealtiWeb Document Updates

After hearing your feedback we’ll be adding a new category next week called LDD Legacy Documents on the Docs screen (when sorted by Category). We will move documents that have been revised (for style and style) into this category for those who want to continue using the previous document version. The documents in LDD Legacy Documents will have an L at the end (for Legacy) and a number (representing the version of the document).

The first documents in this category are:

  • Discharge - Undertaking - L1

  • Undertaking, Warranty, Direction and Declaration - Vendor's - L1

New! Undertaking - Discharge

This document is intended to replace the Discharge - Undertaking (which will be moved into the new category, as per above). The document was rewritten to be more concise. As well it was named Discharge - Undertaking to appear alongside the other Undertaking documents. (The programming in the document has also been simplified compared to the original Discharge - Undertaking document.)

Revisions to Purchaser - Initial Letter

In next week’s update, there will be clauses added to (or revised in) the Purchaser - Initial Letter to address the following:

  1. A non-TitlePLUS specific clause

  2. Improved joint retainer clauses; to handle

    • multiple purchasers;

    • multiple purchasers and ongoing relationship; and

    • acting for both sides

  3. Septic system clause

  4. Private water system clause

New generic title specific clause

With our Chicago Title and First Canadian Title integrations and in preparation for our integration with Stewart Title Insurance, we will be adding a title insurance clause to the following documents (that will appear when TitlePLUS is not selected):

  • Initial Letter to Purchaser

  • Report to Purchaser

Revised Signing Lines

The signing lines for the following documents have been revised to display with no witness signing lines when the signing party is a corporation:

  • Purchaser’s Undertaking and Direction - Title

When the Vendor’s Lawyer is a sole practitioner the signing statement will reflect this in the Ontario - Lawyer’s Undertaking. In a Sale file this is determined by your firm name being blank in Firm Settings.

Updates to Undertaking, Warranty, Direction and Declaration - Vendor docs

The following changes have been made to the Undertaking, Warranty, Direction and Declaration - Vendor and Undertaking, Warranty, Direction and Declaration - Vendor - Vacant Land documents:

  1. Stylistic readability changes (i.e. simplifying clauses to be concise)

  2. Added logic on clauses to appear when appropriate based on*:

    1. Assumed mortgage

    2. No GST/HST applies

    3. Property is Condo

    4. Matrimonial Home statement (appears when at least 1 corporate transferor)

    5. Spousal statement (appears when at least 1 individual transferor)

  3. Declaration changes:

    1. Non-Residency:

      1. If all transferors are Canadian residents: have specific clause

      2. If all transferors are non-residents: do not have a clause

      3. If transferors are mixed: clause specifies the individual transferors only

    2. Individual Transferors over 18 yrs - appears if at least 1 individual transferor

  4. When the transferor is a non-resident corporate (either 1 or all transferors), there is a statement stating “Please remove the jurate.” as a reminder to delete the jurat before signing. The jurat is not applicable when the document does not contain the declaration statements.

*Not all clauses listed apply to both documents.

New Purchaser’s Undertaking and Direction - Title

We have combined the Undertaking to Readjust - Purchaser’s and Direction - Title into a single document (the Purchaser’s Undertaking and Direction - Title).
